Our Vacation Rental Policies
IMPORTANT! Please read before completing your reservation.
Please familiarize yourself with our policies below, before completing your reservation. These are general guidelines, and individual owners will have their own set of guidelines for their specific properties.
To Make a Reservation you must be 25 years of age or older. Person making reservation MUST check-in and stay at unit the entire duration of the reservation.
Reservation will not be confirmed until you are contacted by the owner of the unit you are booking. If for some reason the unit is unavailable, we will try and find a comparable unit, or your funds will be returned, minus any merchant fees.
1. AGREEMENT: MissionBeachRentals.Net, and Tenant agree as follows: Above Tenant is an adult and will be an occupant of the unit during the entire reserved period. Other occupants will be family members, friends or responsible adults. Use of the premises will be denied to persons not falling within the foregoing categories, and as a result they would have to vacate the property immediately without any refund. No keys will be issued to anyone who is not an adult.
2. PETS: Pets are not allowed, unless specified by owner.
3. SECURITY DEPOSIT: Security deposit varies by property. Please refer to your billing information for amount of Deposit.
4. CANCELLATION: Cancellations must be in writing.
If the reservation is made less than 60 days prior to the arrival date, the deposit is refundable if cancelled within 48 hours of making the reservation minus a $100 cancellation fee.
If cancellations are made within 60 days of arrival, the property will be put back up for rent. If the property is rented, all fees collected minus 10% of the rental amount (cancellation fee) will be refunded, otherwise the full rental amount is due and only the city taxes and security deposit fees will be refunded.
5. CHECK IN: Check in time is 3:00 PM, generally on Saturday unless other arrangements are made.. EARLY CHECK IN TIMES ARE ALLOWED ONLY WHEN THE PROPERTY IS CLEANED AND READY FOR OCCUPANCY AND PRIOR APPROVAL IS REQUIRED. Keys and or lock codes will be ready for pick up at property location. Keys and/or lock codes WILL NOT be issued with a balance owing or without a signed rental agreement in the owners, or owner’s representatives, possession.
6. CHECK OUT: Check out time is 10:00 AM. THERE IS AN EXTRA CHARGE FOR LATE CHECK OUT AND PRIOR APPROVAL IS NEEDED. Please leave all keys and remote at the location. A $50 per hour fee will be charged for each hour (or portion thereof) past the required check out time. A $50 per item fee will be charged for each lost key and remote control.
7. CLEANING: Each property will be inspected, sanitized and cleaned after your departure. The cleaning fee you have paid will provide for four hours of normal cleaning so that you can enjoy your vacation up to the last moment. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit at the rate of $50 per hour.
8. TELEPHONES: The property has a telephone available for local calls.. Telephones may be used to make as many local calls as you wish. Should long distance calls be inadvertently charged to the owner, renter agrees to pay for calls, and owner has the right to charge renter’s credit card.
9. WHAT WE SUPPLY: The property is equipped and set up as a fully furnished property that will include bedspreads, linens, blankets, pillows, towels, as well as a fully equipped kitchen. THERE WILL BE EXTRA CHARGES TO YOUR SECURITY DEPOSIT FOR REPLACING THESE ITEMS IF FOUND TO BE NECESSARY.
10. WHAT YOU SHOULD BRING: Plan on packing your personal toiletry items. Since we provide only a limited supply of toilet paper, paper towels, and other dispensable items to get you started on your first day of vacation, you should plan on making a trip to the grocery store to replenish these items as you need them. Please provide your own beach towels and do not use bath towels or bedspreads/comforters on the beach. There is a limited supply of beach towels and beach blankets available.
11. TENANTS LIABILITY: Tenant agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant or Tenants guests, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, Tenant agrees to reimburse MissionBeachRentals.Net, for costs incurred to repair/replace damaged items.
12. SLEEPING CAPACITY/DISTURBANCES: Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: A.) Occupancy exceeding the sleeping capacity stated on the reservation confirmation. B.) Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C.) Causing damage to the premises rented or to any of the neighboring properties. D.) Any other acts which interferes with neighbors’ right to quiet enjoyment of their property, E.) Violation of the San Diego noise ordinance, which could cost you up to $1000 per infraction.
13. HOLD HARMLESS: MissionBeachRentals.Net does not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will MissionBeachRentals.Net accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control.
14. HOT TUB, Barbecue, Balconies & PATIOS: Tenant hereby acknowledges that if the property they have reserved includes a hot tub, the undersigned is fully aware that the hot tub and surrounding patio/deck, barbecue and balconies can be dangerous, that the deck/patio, balcony can be slippery when wet, and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the hot tub, barbecue, balcony and patio areas.
15. Walkways and beach area: Tenant hereby acknowledges that a large section of the beachfront on Mission Beach, walkways, and boardwalk have uneven surfaces The undersigned is fully aware that the ‘riprap’ is jagged, unstable, dangerous, and slippery when wet, and injury is likely to occur to anyone who attempts to walk, climb or sit thereon. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to walking climbing or sitting on the walkways or associated walls.
16. Bicycles: If bicycles are provided in the unit, tenant uses bicycles at own risk. If the tenant is not willing to use the bicycles at their own risk then bicycles may not be used. Please keep all bicycles locked at all times including while INSIDE the garage. There is a very high theft rate in Mission Beach and renters must keep all belongings in a safe place.
17. PARKING: Many parking spaces and garages are small in beach area and may not accommodate all vehicles, especially trucks and SUVs. MissionBeachRentals.Net does not guarantee your vehicle will be able to fit in the parking space provided, nor are we able to provide additional parking if the assigned parking is too small.
18. AIR CONDITIONING: Most Units DO NOT have Air Conditioning
19. RATES & PRICING: Prices are subject to change without notification. However, once the deposit has been received, no price changes will occur to that contract.
20. ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
Reasons for Deposit Forfeiture
* Your deposit is subject to forfeiture for any of the following reasons.
* Failure to depart by 10:00 AM (Unless arranged in advance)
* Additional guests exceeding your confirmed number
* Unauthorized pets
* No loud music or disturbances after 10pm- Please respect your neighbors.
* MissionBeachRentals.Net and property owner are not responsible or liable for any illegal behavior on your part- Violators will be forced to leave and forfeit all rent/tax, and deposit paid.
* No clothing, towels, etc. shall be hung on balconies.
* No bikes or beach equipment in halls, or units.
* No charcoal barbecues on decks.
* Please return furniture in property place, dishes, cleaned and put away, trash taken out or you may be charged additional fees.
* You will be charged for missing items and any damage you cause. If the amount exceeds your deposit, you will be billed for the difference. In the event any dispute amount the parties (guests, owners, or MissionBeachRentals.Net) The matter will be resolved in small claims court.
* No use of on-site washers/dryers after 10 pm.
* No littering of common areas.
* No smoking allowed in the units.
